Terms of Services

This User Agreement (hereinafter - the “Agreement”) regulates the terms of use of the TozheBot AI Service (hereinafter - the “Service”) provided by Limited Liability Company “Neurosell” (TIN: 5948076137, KPP: 594801001, legal address: 614066, Perm region, Perm, Cosmonauts Highway, building 111IK1, room. 29), hereinafter referred to as the “Company”, “We”, “Neurosell”, “TozheBot”.

By using the Service, you (hereinafter - “User”) agree to the terms of this Agreement. If you do not agree with its provisions, please stop using the Service.

1. Service description

TozheBot AI — is a cloud-based platform (SaaS service) that allows business to create a virtual and interactive employee (agents) based on artificial intelligence. The end users of the agents access its functionality through the websites / bots or other channels integrated with TozheBot AI.

2. Members

  • Business / Project owners - legal entities or individuals registered with the Service and using it to integrate the agents.
  • End users - persons using the an agents on the websites of business or in other connected sources. Only adults are allowed to use the agents.

3. Registration and data

In order to use the Service, business owners undergo registration, during which they provide:

  • Project / Company Name
  • Website URL
  • E-mail address
  • Phone number

End users can use the functionality without registration, but uploaded a content can be processed as part of the service operation.

4. Personal data

The Service processes contact and identification data in accordance with the following Privacy Policy.

Content uploaded for widget are processed solely for the provision of the service and are not used for any other purpose.

We comply with the requirements of Russian, EU (GDPR) and US (including CCPA) legislation in terms of personal data protection.

5. Paid services

Paid functions are provided to company / project owners on the terms and conditions defined in a separate document — Public Offer.

6. Limitations

By using the TozheBot AI services, regardless of the site on which the agent widget or portion thereof was placed, you agree that you will not, under any circumstances:

  • Upload of an erotic, pornographic or otherwise inappropriate content;
  • Post, distribute or otherwise transmit material that violates the rights of third parties or applicable law;
  • Use the Service to spread malware, phishing or other malicious activities;

We reserve the right to suspend or terminate access to the Service if you violate these terms.

7. Responsibility

Service is provided “as is”. The Company is not responsible for possible failures, errors or loss of data, if they occurred through no fault of the Company.

The user is personally materially or legally responsible for any content distributed and downloaded as part of the TozheBot AI services.

The company owner warrants that by posting information about their business, brand, its products or when using any photos that the information does not violate anyone's rights and may be used for public purposes, including for advertising purposes without requesting additional authorization from TozheBot AI.

The services involve the work of generative artificial intelligence. Its results may not be predictable. The user also undertakes to use the functionality in good faith.

The Company is not responsible for any discrepancy between the user's expectations and the actual results of the services.

8. Applicable law

This Agreement shall be governed by the laws of the Russian Federation. For US and EU users, the provisions of the Agreement shall apply to the extent not inconsistent with applicable local laws.

9. Terms and procedure of the agreement

This Agreement shall commence upon any use of the TozheBot AI service, including the first time you open a widget hosted on a third party website, or when you register on the TozheBot AI website.

The term of validity of the Agreement is unlimited and indefinite. The updated version of the Agreement is always available at: https://tozhebot.ru/en/terms_of_service/.

The administration of the resource can unilaterally terminate the current Agreement at any violation of the rules.

This Agreement is an integral part of the Privacy Policy and Public Offer.

11. Amendments to the Agreement

The Company has the right to make changes to this Agreement. The current version is always available on the Service's website. Continued use means agreement with the new version.
